Should You Register a Not-for-Profit or a Charity?

The tricky part for many people who want to register a charity or non-profit is to figure out which one they should register.

Often, there are elements of the organization and it’s goals that could define them as either one. If this is the case, it’s a good idea to speak to a professional, who can help you to weigh the pros and cons of each.
It can be a little harder to register a charity because it involves applying to the CRA for charitable organization status.

This is not required for non-profits. But, although both are usually exempt of the requirement to pay income tax, non-profits cannot issue tax receipts when they collect funds. Which can make it trickier to raise funds.

On the other hand, charities have spending requirements. This means that they are legally required to donate a predefined portion of the money they collect to qualifying activities.

We initially applied for charitable status by ourselves before the pandemic. By the time it was over we had reorganized our co-op to apply again. Having completed a charitable application previously with the help of a mentor, I was not overwhelmed by the idea of doing again by myself At the same time certain I did not want to. I reached out to BIG and they were very helpful in sorting what they offered with very clear terms on expected cost. I worked on applying for development grants and secured one that paid the majority of the fee. I reached out to BIG and we entered into an agreement to complete the application. They were prompt in collecting all the documentation and required a minimal amount editing and redirecting through the draft application. The application was submitted in May 2024 and approved in March 2025. Overall we are pleased with all aspects of the service we received from BIG Charity Law.

They managed our charity status application and made the process efficient and simple. They are based in Ontario and we are in Alberta, so there were some questions where they needed to get clarification, related to the different jurisdictions. This did not pose a problem but something to consider if you are based in a different province. The charity registration itself is a matter with the CRA, so that was not an issue.
